Sen. Kirk Watson submitted a brief to the Office of the Attorney General this afternoon in response to a pending request for an attorney general opinion (RQ-0076-KP) regarding “campus carry” legislation.
He argues that the Office of the Attorney General should “allow campus carry policies to be adopted by the presidents of public institutions of higher education, reviewed by the applicable governing boards of those institutions, and monitored on a biennial basis by the legislature before opining on this important issue.”
The Attorney General should not preordain campus decisions when the Legislature specifically granted public institutions of higher education the broad discretion to develop policies that address the unique circumstances of that campus. We cannot assume the facts, and the Attorney General cannot issue an opinion about hypotheticals or speculative scenarios.
